Adding a home smart charger to your lease - Terms and Conditions 

Please read the terms and conditions for including a charger in your lease below carefully.

DriveElectric will supply the home smart charger (Pod Point Solo 3S) and arrange for it to be installed at the home smart charger installation address you provide. 

DriveElectric will enter into a direct contract with the manufacturer of the home smart charger and DriveElectric's chosen installation partner. After doing so, that installation partner will confirm (a) that the specification of the home smart charger DriveElectric has purchased on your behalf confirms with the specification communicated to you, the customer, and set out in the offer summary and the intended installation date.  

DriveElectric will provide details of the guarantees or warranties that the manufacturer and/or installation partner has given to DriveElectric in relation to the quality or fitness for purpose of the home smart charger and/or the standard of the installation.  DriveElectric will use its best endeavours to transfer or assign to you, the customer, the benefit of those guarantees, warranties and/or standards. This means that DriveElectric will be liable to you, the customer, to the same extent as the manufacturer and/or installation partner is liable to DriveElectric. If you need to make any claims under any guarantee, warranty or standard in respect of the home smart charger or its installation, you should contact DriveElectric. DriveElectric will provide reasonable assistance and will respond to any queries that you, the customer, may have about your chosen home smart charger and its installation. DriveElectric will support you, the customer, and encourage its installation partner to take appropriate action. DriveElectric will also require that its installation partner uses suitably qualified personnel to install the home smart charger and that its installation partner complies with applicable laws and provides the installation in accordance with good industry practice. 

You, the customer, will allow DriveElectric's installation partner to access the property at which the home smart charger is being installed and will provide DriveElectric's installation partner with such other information as they might reasonably request.  

DriveElectric will provide these services with reasonable skill and care and in a timely manner and will encourage its installation partner to do the same. Installation dates may be changed by DriveElectric's installation partner and as such time of installation is not guaranteed. If you, the customer, request a change to the installation date, DriveElectric may need to charge you an additional cost to cover any additional costs charged by our installation partner.  

You, the customer, understand that the home smart charger that will be installed at your property. 

From the point of delivery installation at your property, you, the customer, will own the home smart charger and it will become your property. You accept that, as the owner of the home smart charger, you will be responsible for managing and raising any faults or warranty claims. DriveElectric will provide reasonable support if there are any problems with the home smart charger or its installation. The warranty details and, if applicable any installation requirements, will be confirmed separately by DriveElectric or by our installation partner after sourcing the home smart charger.  

You understand that the home smart charger is not a part of any separate car or van leasing agreement that you have arranged through DriveElectric. You will be the sole owner of the home smart charger. DriveElectric will have no ownership rights in relation to the home smart charger. 

In order to process your application, DriveElectric will pass the information to its installation partner. Your personal and sensitive data is fully protected under the Data Protection Legislation, GDPR, and/or to equivalent standards by law. You can also access our installation partners privacy policy at www.pod-point.com/legal/privacy-and-cookies-policy. You have read and accepted those policies (to the extent provided). 

To be eligible for installation, the home smart charger installation address has to meet the following 'standard installation' criteria:- up to 10 meter cable run from your distribution board/consumer unit to the home smart charger location;- home smart charger to be fitted onto a fixed onto brick or plasterboard, or other permanent structure (if you require a mounting post for the home smart charger, this will be an extra cost.) 

If, after our installation partner considers the application, we identify that the home smart charger installation address you have provided does require additional works in order for the installation to be carried out, our installation partner will make you aware of the additional work required and provide you with an additional work cost quote for your acceptance. Any additional cost will need to be paid directly to DriveElectric's installation partner but you have the right at this point to inform us that you would like to cancel your agreement . 

The installation of the home smart charger will be approved/denied based on the information you, the customer, supply on the home survey web form that you will receive from DriveElectric's installation partner. It is important that you complete the form correctly as if you fail to do so it may increase your costs. If you are unsure about how to fill in the form you should contact us, DriveElectric. If during installation, DriveElectric’s installation partner discovers that additional works are required outside of the 'standard installation criteria', as outline in the 'Standard Installation Criteria' section above, this could postpone the smart home smart charger installation until the additional work has been completed and you may be liable for additional costs.  

You are entitled to cancel your agreement at any point and for any reason within 2 weeks of signing and returning this document.  

As explained above, you are also entitled to cancel your agreement if our installation partner informs you that you require a non-standard installation which will result in additional cost.  

If you wish to cancel your agreement you must notify DriveElectric in writing. 

If the home smart charger is delivered and installed before delivery of your electric vehicle, please note that you will remain liable for the cost of the home smart charger and its installation, even if the electric vehicle lease is subsequently cancelled.

DriveElectric will not change your agreement without your prior written consent. 

The information contained in this document is confidential and you must  not share it or disclose it to any other party except your legal advisors. 

This document contains the entire agreement between us, DriveElectric and you, the customer, in relation to the home smart charger. This means you can not rely on any prior written or spoken statements between us in relation to the home smart charger. 

Nothing in this document will exclude DriveElectric's liability for any loss which cannot be excluded at law including loss relating to personal injury or death caused by negligence and/or loss due to fraud. 

The contact that will be formed if you, the customer, accept these terms and conditions is between us, DriveElectric and you, the customer. It is personal and you can not pass the benefit of it to any other person. Likewise, no other person can enforce these terms and conditions. 

Any legal notices relating to this document and our agreement with you in relation to the supply and installation of the home smart charger should be sent in writing to Fleetdrive Management Ltd t/a DriveElectric, Harleyford Marina, Henley Road, Marlow, Buckinghamshire, Sl7 2DX, OR customerservice@drive-electric.co.uk. 

Our agreement with you will be governed by English law and any disputes we may have will be subject to the jurisdiction of the English Courts even if we are supplying to an address in Scotland or Northern Ireland.
